Book your Villa: Terms and Conditions for Our Guests (January 2025)
1. General
The travel agreement consists of these terms and conditions, the booking confirmation, the payment confirmation, and the travel documents. It is the travel agreement between Book your Villa SL (hereinafter: 'ByV' and 'we') and the guest (hereinafter: 'guest' and 'you') for the rental of a vacation home, including the furnishings, garden, and all other amenities (hereinafter: 'vacation home'). ByV acts as the provider of the vacation home.
2. Our Offer on the Website
The descriptions and photos of vacation homes on our website have been carefully compiled. Due to circumstances, it may occur that the description and/or the images appear slightly different from the actual vacation home. For example, the (outdoor) pool may be closed in winter, a wall may have been painted, different beds may have been placed in the vacation home, or there may be a new supermarket nearby, etc. If the differences are significant, you can address this with us. If we have made an error on our website, we are not bound by it.
3. Recreational Stay for Guests
ByV rents vacation homes for recreational stays that are rented for a maximum period of 2 months per booking (as stipulated by law). Only you and the other guests you specify in the booking have access to the vacation home with the stay confirmation. The vacation home may not be used by more guests than specified in the booking confirmation, including children and toddlers. Overcrowding gives ByV the right to retroactively increase the rental price proportionally, plus any additional costs. You are responsible for the travel party and must behave as a good guest. Organizing parties, events, or gatherings with other people is not allowed. Some vacation homes are for families only. Groups of young people up to 25 years old are not allowed. We will clearly indicate this on our website and in the travel agreement if applicable. To make a booking, you must be 18 years or older. A booking made in violation of the above will be canceled by us, and the cancellation costs and any (cleaning) fees will be charged to you.
4. Personal Data
For a booking or request, we ask for personal data from you and the other guests. Our privacy policy outlines the data we process, for what purpose, and the retention period.
5.Request
For a limited number of vacation homes, you can submit a booking request, after which the homeowner will be asked for confirmation. If the request is accepted, the booking becomes final.
6. Booking and Payment
Once you book a house with us or a request is converted into a booking, you will receive a booking confirmation from us via email. After booking, you must immediately make a deposit in euros via credit card or bank transfer. The deposit is at least 35% of the rental price, the full booking costs, and any full premiums for cancellation and/or travel insurance. You will receive the payment confirmation by email. A confirmed booking cannot be canceled free of charge. No later than 6 weeks before the arrival date, you must pay the remaining costs in euros. We will send you a reminder by email one week before the due date. For bookings made less than 6 weeks before departure, the entire rental price must be paid immediately. Payment by bank transfer will no longer be accepted in this case.
7. Late Payment
The date the amount is credited to ByV's bank account is the payment date. If you do not pay on time, ByV can terminate the travel agreement, and cancellation costs and any legal collection costs and interest will be charged to you and possibly offset with the deposit. After cancellation, ByV can no longer guarantee availability of the vacation home.
8. Other and Additional Costs
Additional costs may apply for cleaning, bed linens, energy, and tourist tax, which may need to be paid locally. In this case, these are not included in the rental price. We will explicitly mention on the website and in the travel agreement if you need to pay them on-site.
9. Travel Documents
Once your full payment is received on time, you and the homeowner and/or manager of the vacation home will receive all the necessary information about your stay via email. This includes details of the vacation home, the homeowner/manager, the travel party, the duration of the stay, and other information.
10. Changes to the Booking
ByV may make minor changes to your travel agreement but will inform you in a timely manner. In case of major changes, we will ask you whether you accept them or prefer to cancel the booking (free of charge). The deadline to communicate your choice is 24 hours if we inform you within 14 days before the arrival date, and otherwise 48 hours. If you do not provide a choice, we assume you accept the changes. If you choose to cancel for free, we will refund the rental price you already paid within 14 days, excluding booking costs and any full premiums for cancellation and/or travel insurance. ByV may adjust any increases in taxes, such as tourist tax, in the rental price up to 20 days before the arrival date (unless you have already paid the full rental price). If you want to change the travel agreement, for example, by selecting a different arrival date or accommodation, ByV may charge cancellation costs for this.
11. Cancellation by ByV
Of course, ByV does not want to disappoint you, but it may happen that we must cancel your final booking within one working day. We will inform you immediately of the reason, and you will receive your (deposit) payment back within 14 days, including booking costs, but excluding any full premiums for cancellation and/or travel insurance. Even before the arrival date, ByV can still cancel the travel agreement if it is reasonably impossible to fulfill the agreement due to unavoidable and extraordinary circumstances. In this case, ByV loses the right to the full payment of the booking, and we will refund the amount you already paid, including booking costs, but excluding any full premiums for cancellation and/or travel insurance. During the stay, there are also situations where ByV can terminate the rental agreement without notice. This occurs if you persistently disturb the stay despite reminders or behave in such a way that immediate termination of the agreement is justified. This is the case, for example, if you cause nuisance or (noise) disturbance to others. In this case, the travel cost will not be refunded.
12. Cancellation by You as a Guest
When you wish to cancel your final booking, we have already incurred costs, so we will charge the following percentage of the rental price (booking costs and any insurance premiums are not refunded):
- Cancellation up to and including the 43rd day before the arrival date: 35% of the total price
- From 42 to 29 days before the arrival: 60% of the total price
- From 28 to the last day before the arrival: 90% of the total price
- For later cancellations (on the day of arrival) or no-show: 100% of the total price.
If you have paid the rental price or a deposit, we will offset the cancellation costs with this (deposit) payment. We process cancellations during our business hours. If a cancellation comes in at the end of the day, we will process it on the next working day (Monday to Friday). That last day is decisive for determining the cancellation costs. If you booked a vacation home through one of our partner websites, the cancellation conditions of that partner may apply. This will be mentioned in your booking.
13. Check-in and Check-out
You can usually check in between 17:00 and 20:00. If this is different for your stay, it will be mentioned in the travel documents. Contact the manager to agree on a more precise time for a smooth key handover. If you are unable to arrive at the specified time, contact the homeowner/manager to discuss the possibilities. The owner or manager may charge additional fees for a later check-in time. Additional costs may also apply for a different check-out time.
Please leave the vacation home neat at check-out: clean dishes, beds stripped, floor swept, and trash placed in the designated spot. If this is not done, we may charge cleaning costs.
14. Instructions from the Homeowner
We expect you to follow the instructions of the homeowner/manager and treat the homeowner/manager and the vacation home with respect. This includes ensuring that you: i) do not cause (noise) nuisance or disturbances, ii) use the bed linens on the beds, and iii) leave the vacation home as you found it at check-in.
Additionally, many homeowners have a personal housebook with tips about the house and the most important house rules.
15. Alternative Vacation Home
If the stay does not meet your expectations or if there are issues with the vacation home, notify the homeowner/manager immediately during your stay. If you cannot resolve the issue together, notify us immediately so that both parties still have the opportunity to come up with an appropriate solution. Only if it significantly affects your stay can a suitable solution be a comparable alternative accommodation or a reasonable reduction in the rental price. ByV is not obliged to find a solution if it is impossible or if unreasonable high costs are involved. If you do not report it immediately, you lose the right to compensation.
16. Assistance and Support
If you encounter difficulties during your stay, call the homeowner/manager or our 24/7 SOS service line as soon as possible. You will find the phone numbers in the travel documents.
17. Damage
It may happen that you or someone else in your travel party causes damage to the vacation home or its surroundings. Report this to the homeowner/manager as soon as possible and inform us. You are liable for the damage. The damage will be deducted from the deposit. If the damage amount exceeds the deposit, you must pay the difference to the homeowner or to ByV. You can claim the costs back through your own liability or travel insurance.
18. Complaints
If ByV does not provide a suitable solution within a reasonable time, you can submit a complaint to ByV. Preferably during your stay, or otherwise as soon as possible after your stay. If the complaint is not known to ByV within 2 weeks after your stay, we will not address the complaint. Please note that service providers (such as the homeowner and manager) are not parties to our travel agreement and are not representatives of ByV. They are not authorized to acknowledge claims or issue and/or receive legally binding statements.
19. For Your Information
- When booking a vacation home, you must always indicate if you want to reserve extra beds and/or cots. This will be explicitly mentioned in the booking confirmation you receive immediately after booking your vacation home. Check carefully if a cot is included in the maximum number of allowed persons or if an additional child is allowed in the vacation home. Cots are generally suitable for children up to 2 years old. For a cot, you must always bring your own bedding.
- Many homes have internet/Wi-Fi. The website and your booking confirmation will indicate if the vacation home has internet/Wi-Fi. ByV is not responsible for availability, speed, compatibility, and security; usage is at your own risk. Internet/Wi-Fi in the vacation home is for vacation purposes only, not for business use. When using the internet/Wi-Fi, you must comply with applicable laws. This includes not downloading files or accessing data that contains (such as movies and music) copyrighted material that has been distributed illegally.
- The website and your booking confirmation will indicate if the vacation home has a pool. Often the opening dates for the pool season are listed. It's important to know that weather conditions may cause the listed dates to change. Also, consider the opening hours of pools in holiday complexes and the possible rules for using the pool.
- It is not allowed to use or connect high electric load devices, such as, but not limited to, air conditioning, e-bikes, and electric cars unless otherwise stated in the travel agreement.
20. Liability
ByV is not liable for costs due to damage caused by the following:
- Faulty actions or omissions by you or someone traveling with you;
- Unforeseeable or unavoidable shortcomings by third parties, such as a fire in or around the vacation home or an issue with local electricity or water supply;
- Unavoidable, extraordinary circumstances, such as extreme weather conditions, the presence of insects, stray dogs, or the condition of public roads.
ByV's liability is limited to three times the rental price, unless it concerns intentional or negligent actions by ByV or personal injury. ByV's liability may be further limited or excluded if ByV acts as an intermediary between the guest and the homeowner. Your right to claim compensation and/or reimbursement expires after one year. The limitation period starts on the last day of your stay as indicated in the travel agreement.
21. Additional Services
If you book an additional (travel) service through a link on our website with another party, this additional (travel) service does not form part of your travel agreement with ByV.
22. Disputes and Applicable Law
If your complaint is not satisfactorily resolved, you have the right to refer it to the court in Barcelona. Spanish law applies to the travel agreement, and disputes will be resolved by the court in Barcelona, with the Spanish version of these terms and conditions being decisive. Only mandatory law of the country where the guest resides or where the vacation home is located can override the relevant provisions in the travel agreement; other provisions remain unaffected.
23. Regulations: Passports, Visas, Health, Customs, and Foreign Currency
You are responsible for complying with the regulations of the countries of entry and departure, as well as health regulations, passport and visa requirements, and pet admission rules. Embassies/consulates in the countries you will visit will also provide you with information. All fines you incur due to non-compliance with these regulations, especially the payment of cancellation costs, are your responsibility unless they result from the provision of incorrect or insufficient information by ByV.
