1. Data Controller

For the operation of Book Your Villa (hereinafter referred to as ByV or we), it is necessary to process personal data of our website visitors and guests (hereinafter guest or you) so that you can, for example, book one of our holiday homes. Of course, we handle all personal data discreetly and carefully. We ensure that we comply with applicable laws and regulations, and adhere to the requirements set out by privacy laws, including statutory retention periods.

This means, among other things, that we:

• Explain why we process personal data (through this privacy policy);
• Only collect personal data that is necessary for legitimate purposes;
• Ask for your consent to process your personal data where required;
• Take appropriate security measures to protect your personal data. We also require other parties who process personal data on our behalf to do the same;
• Always respect your right to access, correct, or delete your personal data upon request.

ByV is the responsible party for data processing. In this privacy policy, we specify which personal data we collect and use and for what purposes.

 

We may update our privacy policy from time to time. The current version is always available on our website.

 

2. How Does ByV Process Your Personal Data?

We process your personal data in connection with the (possible) rental of holiday homes for recreational stays. Below, we outline when your data is processed, what data is collected, for what purposes, and how long we retain your data (legal basis).

 

2.1 Cookies on the Website

Our website uses cookies. Cookies are small text files that your device or browser stores when you visit our website. They improve your website experience. If you visit our website again, your device or browser is recognized. This is necessary for remembering favorites, saving account details so you don't have to re-enter them, and analyzing and improving the use of our website.

 

When you first visit our website, we ask for your consent to place cookies. If you continue using the website, the initial consent remains valid. Of course, you can disable cookies through your internet browser settings, but our website may not work as optimally.

 

Other parties we work with may also place cookies. Although we have agreements with them regarding the use of cookies and applications, we do not have full control over what they do with the cookies once they read them (according to their own privacy policies).

 

2.2 Sending the Newsletter

You can sign up for our newsletter through our website, even without an account. If you have made a booking (or previously made one), you will receive our newsletter. It keeps you informed about interesting offers, our services, and important information.

 

We send the newsletter to your email address, and your address is added to our contact list. Each newsletter contains an unsubscribe link. If you unsubscribe, we anonymize your email address unless it is needed for other purposes as described in this privacy policy (e.g., if you have made a booking with us).

 

2.3 Answering Your Questions, Issues, or Complaints

You can ask questions via a contact form on our website. To respond adequately, we ask for certain personal data. We retain the data you send us for as long as necessary to answer your question completely.

 

You can also contact us by phone, chat, or email (without a ByV account) for a question or issue. With your consent, we store your data to respond effectively and handle any future inquiries or bookings.

 

If you already have an account when contacting us, we use the personal data we already have.

 

We always record when and through which channel we contacted you, the reason for the contact, and the content of the conversation or exchanged emails.

 

If you did not enter into a travel agreement with us, we retain this data for two years.

 

If you have a travel agreement with ByV, we retain the data for seven years after the end of the travel agreement.

 

2.4 Registration

How does it work? If you're interested in renting a holiday home, you can register with us. We ask for your name, email address, and/or phone number to inform you about holiday homes that may suit you. If you don’t proceed with a booking, we will delete your personal data after two years.

 

2.5 Your Account

Before making a booking, we ask you to create an account on our website. By doing this, you give ByV permission to process your personal data. You will need to provide at least your email address and choose a strong password (which we store in encrypted form). Through your account, you can manage your data and delete the account yourself.

We keep account data as long as the account is active.

 

2.6 During a Booking

When you make a booking, we need additional personal data:

• Name
• Address
• Email address
• Phone number
• Composition of the travel group
• Payment details

 

You also provide other information, such as:

• Group composition
• Which holiday home
• Stay period
• Any special requests

We use this data to communicate with you about your booking status, booking confirmation, terms and conditions, insurance conditions, costs, payment method, travel documents, and service.

Additionally, we use booking data to anonymously and aggregately analyze our business operations and improve them.

Once your travel agreement has ended, we retain the personal data used for bookings and invoices for seven years.

 

2.7 Travel Agreement

We provide your name, address, email address, and phone number to the owner of the holiday home you book. We also inform them of the composition and personal data of your travel group for local authority registration and tourism taxes.

 

To comply with (local) legislation, we may be required (e.g., in Spain) to ask for your ID or tax number. We only use this information if (local) governments require it and it is legally mandated.

 

2.8 Payments

We work with a payment service provider to handle your payment to us. This provider is responsible for processing your personal data (according to their privacy policy).

 

2.9 Reviews

ByV and the holiday home owner greatly appreciate it if you leave a review after your stay. The review will be visible to all website users. You will be asked for your full name or at least your first name and place of residence. This enhances the reliability of the review. We advise against including any personal information in the review.

 

We only post the review after your approval. You can also always ask us to remove a posted review. ByV reserves the right to refuse reviews at its discretion and without giving reasons. We are also free to use reviews in other marketing materials and share them with our other brands and partners.

 

2.10 Marketing

We may combine personal data, as mentioned in the above sections, to inform you about new products and services, tailor our services to your needs, and to attract and retain customers. This may include emails (newsletters), mail, phone, and banners or ads on websites.

 

We measure the effectiveness of these marketing activities. Using this data is necessary for ByV in its legitimate interest to inform guests and other website users.

 

You can always unsubscribe from the newsletter, opt out of receiving commercial mail, and object to the use of your personal data for direct marketing purposes.

We also use cadastral data to clean postcodes and addresses.

 

2.11 Competitions

If you participate in a competition or other promotion from ByV, we process your name, email address, and/or phone number to assess your entry. The purpose is to contact you if you win a prize. Some competitions may have additional rules regarding the use of personal data.

 

2.12 Partners and Other Parties

ByV collaborates with partners (such as Online Travel Agencies) to reach more holidaymakers and offer a wider range of options. If you book a holiday home through one of these partners, their own privacy statement and terms may apply. ByV is not responsible for these.

 

ByV also works with other service providers (e.g., IT services, marketing research, payment processing). We only share your personal data with them if necessary for these services. They have their own privacy policies and terms. ByV accepts no responsibility or liability for this.

 

Other parties we engage include those for displaying relevant ads or running competitions, such as Facebook, Twitter, Instagram, and Google. These social media channels use their own privacy statements and terms, for which ByV takes no responsibility.

 

We only share personal data with third parties who guarantee that they have implemented the required measures to protect personal data adequately. We enter into data processing agreements with these parties that regulate the confidentiality and security of your data.

 

If these parties are located outside the EU and the country in question does not provide an adequate level of protection, we ensure that an agreement with the third parties includes standard contractual clauses approved by the European Commission or take other appropriate measures.

 

We only provide personal data to regulatory authorities, law enforcement, and tax authorities when legally required.

 

2.13 Retention Period

For most cases, the retention periods for personal data have already been mentioned above. In other cases, we retain your personal data as long as necessary for the purposes outlined in this privacy policy and for complying with (local) laws and regulations. After that, we will delete or anonymize your personal data for analytical, historical, or other business purposes.

 

2.14 Security

ByV takes security measures to protect your personal data from loss or any form of unlawful processing. For example, we conduct regular security scans on our websites. The internet connection is secured with an SSL certificate (indicated by https:// and the padlock icon in your browser).

In addition, under certain circumstances, you have the right to request the deletion or restriction of your personal data, and to request that your personal data be provided to you or other parties.

If we send you messages about your holiday home booking, this is part of our obligations under our travel agreement, and you cannot unsubscribe from such messages.

You may object to the processing of your personal data by ByV, especially when it is processed based on ByV's legitimate interest, as outlined in this privacy policy.
